EU Battery Regulation Article 11: What Oral Care Importers Must Change Before 18 February 2027

Article 11 of the Batteries Regulation (EU) 2023/1542 applies from 18 February 2027 — roughly five months away. It requires portable batteries built into devices to be removable and replaceable by the end user. Electric toothbrushes and water flossers get a partial exemption, because they are appliances used in or exposed to water, which permits battery replacement by an independent professional where necessary for safety. The rest of Article 11 — cross-brand battery compatibility, printed and online instructions, software neutrality and a five-year spare-parts obligation — can still apply. A device that fails Article 11 cannot be CE marked and therefore cannot be sold in the EU.

What exactly does Article 11 require?

1. The whole battery — not individual cells — must be removable and replaceable by the end user, using commercially available tools or specialised tools supplied free with the product.

2. It covers portable batteries : sealed, weighing

5 kg or less, not industrial, EV, LMT or SLI. Instructions

3. must ship with the product and be available online.

4. A compatible battery from another brand must fit, without affecting functionality, performance or safety, and software must not negatively affect a replacement battery.

5. That battery type must stay available as a spare part for at least five years after the last unit of the model is placed on the market.

Why do IPX7 toothbrushes and water flossers get a partial exemption?

Article 11 allows the battery to be replaceable only by an independent professional where necessary for product safety, for three device classes — the first being "electronic appliances used for operating in or exposed to water." An IPX7 sonic toothbrush or a cordless water flosser with a sealed, wet-use handle is squarely that class, so a glued-shut, professionally serviceable handle can remain viable — if the safety justification is documented and the remaining obligations are met.

Those remaining obligations are the ones importers miss: the five-year spare-parts term, instructions in the box and online, cross-brand battery compatibility, and software neutrality. The spare-parts clause in particular pushes designs toward standardised cells rather than bespoke welded packs.

Does this apply to stock already in the EU?

Units placed on the market before 18 February 2027 are not subject to the spare-parts obligation, and existing stock need not be discarded. But a model continuing to be placed on the market after the deadline must comply — the cut-off is per placement, not per manufacture date. If no exemption applies, a non-compliant device cannot carry CE marking, cannot be sold in the EU, and units already on the market can be recalled.

Will brands build an EU-only version?

Probably not for long. Compliance Gate records that Nintendo is expected to launch an EU version of Switch 2 with user-replaceable batteries, and notes that Apple replaced Lightning worldwide shortly after the EU implemented its USB Type-C requirements. The pattern points to one global SKU rather than a regional variant.

Are the exemption lists final?

No. Article 11(4) lets the Commission add exemptions, and ecocomply.ai reported on August 22, 2026 that six new exemptions were adopted in July 2026. The detail was not retrievable from that source, so treat the count as reported and verify against the Official Journal before relying on any specific relief.

Note also that Ecodesign Regulation (EU) 2023/1670 covers only smartphones, other mobile phones, cordless phones and slate tablets — not oral care. Its conditions (≥83% capacity after 500 cycles, ≥1,000 cycles at ≥80%, IP67) are an engineering benchmark, not a legal route. And since GPSR (EU) 2023/988 has applied from 13 December 2024 (SGS) while a 5 V USB-C device sits outside the Low Voltage Directive, CE marking for a brush rests on EMC, RoHS, GPSR, the Battery Regulation and RED where a radio is present.

What should you do, and when?

Window

Action

Now

List every EU model and its battery type; ask the factory whether the cell is standardised and how long they will supply it

Before production

Confirm the Article 11 route per model — end-user replaceable, or professional replacement under the water-exposure clause with documented safety justification

Before production

Draft removal and replacement instructions for the box and the website

Before shipment

Verify firmware does not restrict third-party batteries; confirm the CE technical file covers Article 11

Suppliers already building to a serviceable architecture — IPX7 cordless water flossers with removable tanks and replaceable heads, such as Charmhome's — shorten this conversation, but the importer still owns the compliance file.

FAQ

When does Article 11 apply, and are electric toothbrushes exempt? From 18 February 2027, and only partially exempt: appliances used in or exposed to water may have the battery replaced by an independent professional where necessary for safety, but the other obligations can still apply.

How long must spare batteries be available, and what happens if my device does not comply? The battery type must stay available for at least five years after the last unit of that model is placed on the market. A non-compliant device cannot be CE marked, cannot be sold in the EU, and units already on the market can be recalled.
